We at iQmobile Pty Ltd and its related companies, including (“iQcheckpoint,” “iQauditor,” “us,” “we,” or “our”), recognize and respect the importance of maintaining the privacy of our Customers and their Personnel. We are committed to ensuring compliance with data protection legislation where applicable to iQcheckpoint, including the European General Data Protection Regulation (Regulation (EU) 2016/679) and its UK equivalent (the “GDPR”), Australia’s Privacy Act 1988 (Cth), and the California Consumer Privacy Act 2018 (the “CCPA”). This Privacy Notice describes the types of Personal Data (as defined below) we collect from you when you visit our website and/or use our Platform or App (collectively, the “Services”), as well as the ways in which we collect, process, transfer, store, and disclose such Personal Data.

Additionally, it explains how you can manage certain uses of your Personal Data. If terms are not defined herein, they have the meanings given to them in the Terms and Conditions.

This Privacy Policy covers your use of iQcheckpoint’s workforce management subscription solutions, whether accessed online, through software applications, or any other iQcheckpoint services and products linked to or referencing this Privacy Policy. This includes support services provided to your employer organization or directly to you. It also applies to any interactions with us, including visits to our website or communication over the phone.

iQcheckpoint Services are primarily designed for use by employer organizations. The subscribing party will manage its instance of the Services and bear responsibility for the personal information it shares with iQcheckpoint.

Please be aware that if iQcheckpoint provides the Services to your employer organization, we utilize your personal information to facilitate your access and usage of the Services on behalf of your employer organization. This categorizes us as a “processor” under the GDPR. However, there are instances where we may use your personal information for purposes unrelated to your employer organization, such as when you use the Services or contact us independently of your employer. In these cases, we may act as a “controller” under the GDPR. This differentiation between our roles as processor and controller carries various implications under the GDPR.

This Privacy Policy does not extend to third-party websites, applications, or software that integrates with the Services, nor does it cover any other third-party products, services, or businesses.

Some aspects of your personal information, such as profile details, are essential for various Services. Failure to provide requested information for a specific Service may result in an incomplete provision of the Services, limiting your overall experience with them.

IQmobile built the IQcheckpoint app as a Commercial app. This SERVICE is provided by IQmobile and is intended for use as is.

If you choose to use our Services, then you agree to the collection and use of information in relation to this policy. The Personal Information that we collect is used for providing and improving the Service. We will not use or share your information with anyone except as described in this Privacy Policy.

The terms used in this Privacy Policy we have the same meanings as in our Terms and Conditions, which is accessible at IQCheckPoint unless otherwise defined in this Privacy Policy.

Information Collection and Use 

For a better experience, while using our Service, I may require you to provide us with certain personally identifiable information, including but not limited to Location. The information that we request is retained on your device and is not collected by us in any way. 

When using certain functionalities in our App, you may be prompted to share your mobile device’s precise (GPS) geo-location information, including latitude and longitude coordinates of physical locations visited. The collection of this geo-location data is solely determined by your Account Owner or Administrator, and iQcheckpoint acts only as a “data processor” with respect to such information. For instance, your Account Owner may require verification of your location via your device for activities like clocking in or out. 

If you prefer not to allow the collection of your precise location, you can typically disable this feature by adjusting the privacy settings of your mobile device or adjusting permissions for the App. However, please note that disabling geo-location tracking may affect the functionality of certain features in the App. It’s important to understand that iQcheckpoint does not utilize geo-location data for its own purposes; the use of such data and the legal basis for its collection and processing are determined by the Customer associated with your account.

Data Collection 

When you use our Services, data is automatically collected and generated through analytics tools, including cookies and pixels. This data includes information about how frequently users engage with the Services, their interactions and usage patterns, as well as technical data related to the Platform’s performance, functionality, and security. For more details about the cookies and similar technologies we use and how to adjust your preferences on the Platform or App, please refer to the respective section. Additionally, we collect information about your computer or mobile device, such as operating system, browser type, internet service provider, language settings, IP address, browsing history, connectivity, session recordings, technical and usage data, activity logs, installed or utilized cookies and pixels, clicks, feature usage, and other interactions. We may also gather details about your viewing history, browser language, and time zone. 

Collect Personal Data, including: 

Information submitted through forms and inquiries, such as support requests, interactions via instant messaging apps, event registrations, participation in online and offline communities and activities, surveys, feedback, testimonials, phone calls, video conference recordings, written correspondences, screen recordings, screenshots, and related information. 

Referral Registration Data: When a User refers a friend to our Services, the User is required to provide us with their friend’s contact details, including full name, email address, and phone number. 

Uploaded Material 

Any personal data, such as text, documents, and images, that you upload to the Platform is considered data uploaded. iQcheckpoint does not utilize this data for its own purposes but acts solely as a “data processor” regarding such data. The use of this Personal Data and the legal basis for its use will be determined by the Customer associated with your account. 

Cookies 

Cookies are files with small amount of data that is commonly used an anonymous unique identifier. These are sent to your browser from the website that you visit and are stored on your device internal memory. 

This Service does not use these “cookies” explicitly. However, the app may use third party code and libraries that use “cookies” to collection information and to improve their services. You have the option to either accept or refuse these cookies and know when a cookie is being sent to your device. If you choose to refuse our cookies, you may not be able to use some portions of this Service. 

Service Providers 

We may employ third-party companies and individuals due to the following reasons: 

• To facilitate our Service; 

• To provide the Service on our behalf; 

• To perform Service-related services; or 

• To assist us in analyzing how our Service is used. 

We want to inform users of this Service that these third parties have access to your Personal Information. The reason is to perform the tasks assigned to them on our behalf. However, they are obligated not to disclose or use the information for any other purpose.

Personnel

We mandate that new employees sign non-disclosure agreements in accordance with relevant laws and industry standards.

Our Customers may opt to use third-party services to integrate with our Services (“Third-Party Providers”), or to enhance the functionality of the Services (provided our Services support such integration). The processing of your Personal Data by the Third-Party Provider is subject to the agreement between the relevant Customer (or you) and such Third-Party Provider.

In the event that iQcheckpoint or any of its subsidiaries or affiliates undergoes a change in control or ownership, such as through a merger, acquisition, or purchase of substantially all or part of its assets, your Personal Data may be disclosed to or transferred to the parties involved in such an event. We may disclose Personal Data to a third party during negotiations, in connection with, or as an asset in such a corporate business transaction. Personal Data may also be disclosed in the event of insolvency, bankruptcy, or receivership. Additionally, we may disclose your Personal Data where such disclosure is necessary to protect our legitimate business interests, including the security or integrity of our products and services.

We may periodically update our Privacy Policy. It’s recommended that you review this page regularly for any changes. We will notify you of any updates by posting the new Privacy Policy on this page. These changes take effect immediately after they are posted.
